By accessing or using the Dental Brainiac™ website ("Service") at www.dentalbrainiac.com, you agree to be bound by these Terms of Service. If you do not agree, please do not use our Service.
2. Description of Services
Dental Brainiac™ is a patient commitment operating system for dental practices, currently in controlled alpha.
At this time, we offer:
- Information about our upcoming product
- A waitlist signup for product updates and early access invitations
The full product is under development. Features and availability are subject to change without notice. Patient Concierge™, our AI call-handling and alert feature, is available to onboarded beta customers as part of this controlled alpha.
3. Waitlist and Communications
By joining our waitlist, you agree to receive:
- Email communications about Dental Brainiac™
- Product development updates
- Early access or beta program invitations

4. User Responsibilities
When using our Service, you agree to:

- Not interfere with the Service or its infrastructure
5. Patient Concierge™ Practice Alert SMS Program
Dental Brainiac™ offers optional automated text alerts through Patient Concierge™ to authorized dental-practice users. These alerts provide operational information about calls handled for the practice and may include new patient bookings, emergency calls, escalations, upset or angry callers, cancellation or rescheduling requests, billing or insurance questions, hang-ups or calls without a caller response, and other alert categories selected by the user.
By providing a mobile phone number and affirmatively opting in, you consent to receive recurring automated text messages from Dental Brainiac™ at the number provided. Message frequency varies based on call activity and your selected alert preferences. Standard message and data rates may apply. Consent to receive text messages is not a condition of purchasing or using Dental Brainiac™ services.
You may reply STOP at any time to stop receiving text messages. After submitting a STOP request, you may receive one final message confirming your opt-out. To request assistance, reply HELP or contact us at support@dentalbrainiac.com.
Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and is outside the control of Dental Brainiac™.
You represent that you are the subscriber or customary user of the mobile number provided and are authorized to consent to receive messages at that number. If your mobile number changes or is reassigned, you agree to update your account promptly.

6. Login Verification Text Messages
When you request a login verification code, Dental Brainiac™ may send a one-time automated text message containing the code to the mobile number you provide or the verified mobile number associated with your account. Standard message and data rates may apply. The frequency of these messages depends on your login and verification requests.
Do not share a verification code with anyone. Dental Brainiac™ will not contact you to ask for your verification code. If you did not request a code, do not use it and contact support@dentalbrainiac.com.
For assistance, reply HELP or contact support@dentalbrainiac.com. Where applicable, reply STOP to block further text messages. Blocking authentication messages may prevent you from signing in by SMS.

Dental Brainiac™, including its logo, content, and features, is protected by copyright and trademark laws.

8. Privacy
Your use of the Service is governed by our Privacy Policy.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by applicable law, Dental Brainiac™ expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will be uninterrupted, secure, error-free, or that the information provided will be accurate or complete. Any reliance you place on the Service is strictly at your own risk.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DENTAL BRAINIAC™ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
This includes, but is not limited to, loss of profits, data, goodwill, or other intangible losses resulting from your use of or inability to use the Service.
This limitation applies regardless of the legal theory (contract, tort, negligence, or otherwise), even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above limitations may not apply, and you may have additional rights.

We may terminate your access at any time, without notice, for any reason including breach of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of Texas, United States. Any disputes shall be resolved in Dallas, Texas.
